User Service Agreement

I. Core Definition of Product and Service

Hello! Thank you for choosing iTV Remote (hereinafter referred to as "this App") – an intelligent remote control tool designed for user devices, aiming to provide you with convenient TV control and multi-scenario smart services.

This Agreement is a legally binding agreement between you (hereinafter referred to as "User") and the operator of this App (hereinafter referred to as "we", "us") regarding your use of this App and related services. Please read and understand all terms carefully, paying special attention to service risks, limitation of liability, and dispute resolution (marked in bold). If you are under 18 years old, you should read this Agreement with your legal guardian and use this App only after obtaining your guardian's explicit consent.

II. Agreement Effectiveness and Acceptance Rules

1. Effective condition: By downloading this App from the Apple App Store, authorizing necessary permissions such as Bluetooth and local file access, and launching any function, you are deemed to have fully read, fully understood, and voluntarily accepted all terms of this Agreement. If you do not agree to any content of this Agreement, you should immediately stop downloading, installing, or using this App, and uninstall the application.

2. Governing law: The formation, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the mainland territory of the People's Republic of China (excluding all conflict of law rules).

3. Agreement updates: We may revise this Agreement based on business adjustments, legal changes, or technological upgrades. The updated Agreement will be published on this App's "Settings – User Agreement" page and become effective from the date of publication. Your continued use of this App after the update constitutes acceptance of the revised terms. If you do not agree to the changes, you should stop using this App before the update takes effect.

III. Eligibility and Permission Requirements

(A) Eligibility Restrictions

1. You must have full civil capacity to use this App independently. Minors under the age of 14 are not permitted to use this App.

2. Minors between 14 and 18 years old (limited civil capacity) must obtain their legal guardian's explicit consent before using this App.

(B) Device and Permission Requirements

1. Download channel: You must download this App from the official Apple App Store. Cracked or modified versions from unofficial channels do not support core functions, and we assume no responsibility for the risks of using such versions.

2. Description of necessary permissions: Using the core functions of this App requires you to authorize corresponding permissions. You can manage them through your device's "Settings – Privacy & Security – iTV Remote". The specific permissions and purposes are as follows:

·Bluetooth & WiFi permissions: Used to establish connection with devices and transmit remote control commands. Enabled only when actively connecting to a device; does not scan surrounding devices in the background when not connected.

·Local file access permission: Used to read photos, videos, documents, and other resources that you actively select for screen casting. Does not batch scan or store unselected files.

·Network permission: Used to scan and connect to devices on the same local area network; used for cross-network screen casting; and for App version updates.

·Notification permission: Used to receive screen casting completion reminders and usage statistics pushes. Disabling does not affect normal use of core functions.

·Microphone permission: For voice control (if applicable).

  1. Device compatibility: This product relies on protocols such as Bluetooth, WiFi, and network screen casting, and cannot guarantee full compatibility with all brands, models, or OS versions of TVs or smart devices. Common incompatibilities include but are not limited to: devices supporting only infrared remote control, too low Bluetooth protocol version, mismatched screen casting protocols, operating system customization restrictions, unstable network environment, etc.

You acknowledge and agree: For any failure to use or functional limitation caused by the above compatibility issues, we do not provide any form of refund, compensation, or exchange. Please fully evaluate whether your device meets the usage conditions before purchase, or verify compatibility through a trial period.

IV. Usage License

The usage license we grant you is a personal, non-exclusive, non-transferable, revocable, limited license, allowing you to use this App only for non-commercial purposes on your own single device. The specific scope of license includes:

  1. Installing, running this App, and using all free functions.
  2. If you purchase paid services, you may use the corresponding functions within the subscription period, for personal use only, and may not sublicense, rent, or sell to third parties.
  3. Connecting to devices that you lawfully own or are authorized to use, generating and storing custom button configurations, usage duration statistics, and other data. All data is stored locally on your device by default; we do not actively collect or upload to servers (for specific privacy protection rules, see the Privacy Policy).

V. App Store Subscription Service Description

1. Subscription Payment Method
This App provides paid subscription services through the Apple App Store. After you confirm the purchase and payment, the amount will be charged to your iTunes account. The specific subscription package, price, and benefits are as published within this App.

2. Automatic Renewal Mechanism
The subscription service of this App has automatic renewal enabled by default. Within 24 hoursbefore the end of each subscription period, the Apple App Store will automatically deduct the subscription fee for the next period from the payment account linked to your Apple ID. After successful deduction, the subscription period will be automatically extended. You acknowledge and agree that the automatic deduction does not require re-verification of your account password, payment password, SMS verification code, or similar information.

3. Cancellation and Unsubscribe Method
(1) To cancel automatic renewal, you must complete the cancellation operation at least 24 hours before the end of the current subscription period; otherwise, the system will consider that you agree to continue the subscription and the automatic renewal deduction will proceed.
(2) Cancellation method:

·Open iPhone/iPad "Settings" → tap Apple ID at the top → select "Subscriptions" → find this App and tap "Cancel Subscription" → confirm to turn off automatic renewal.

·For Mac users: Open App Store → tap your avatar to enter "Account" → select "Subscriptions"to manage.
(3) Important note: Uninstalling or deleting this App will not cancel the subscription. You must manually turn off automatic renewal through the above system-level path. After cancellation, you may still continue to use the paid subscription service until the end of the current subscription period.

4. Refund Policy
This subscription service is paid and settled through the Apple App Store. Once a deduction is successful, except as otherwise provided by laws or regulations, the operator of this App will notissue a refund. If you need to request a refund, please contact Apple Inc. directly through the official Apple channel ("Report a Problem" in your Apple ID purchase history).

VI. Prohibited Conduct

You must not engage in any of the following conduct while using this App. If you violate these terms, we have the right to take measures such as limiting functions, suspending services, or prohibiting use, and will not refund any fees paid:

1. Damaging software integrity:

·Reverse engineering, decompiling, cracking, or modifying the remote control protocol or functional code of this App (e.g., tampering with button command logic).

·Developing or using plug-ins, scripts, or other tools to interfere with the App's operation, such as automatically clicking game buttons or batch modifying usage duration data.

·Unauthorized access to the App's backend system or server data, or spreading software vulnerabilities or bugs that cause functional abnormalities to other users.

2. Commercial use and illegal profit:

·Using this App for commercial operations, such as providing paid screen casting services for enterprises or selling custom remote configurations to third parties.

·Exploiting compatibility vulnerabilities of this App to provide TV device hacking or illegal control services to others, or reselling paid feature benefits.

3. Illegal and infringing conduct:

·Screen casting or disseminating illegal, fraudulent, harassing, or advertising content, such as pirated videos, other people's private files, or false promotional materials.

·Controlling others' TV devices without authorization, or infringing third-party intellectual property rights through screen casting.

·Interfering with other users' use, such as frequently initiating invalid Bluetooth connections causing TV lags, or occupying public network resources affecting others' screen casting.

4. Other prohibited conduct:

·Falsifying or tampering with usage duration statistics data, or using such data for commercial proof or dispute evidence.

·Spreading malicious programs or modifying original data.

VII. User Conduct and Data Responsibility

1. Content responsibility: You bear sole responsibility for the content generated or transmitted through this App (screen casting files, remote operation records, custom configurations, collectively "User Content"), ensuring that the content is lawful and does not infringe upon third-party rights. If a dispute arises due to infringement of User Content, you shall bear legal liability.

  1. Data management: You should back up User Content stored locally on your device. We are not liable for data loss due to device loss, accidental uninstallation of the App, or system failure. After uninstalling this App, all related data on the device will be permanently deleted and cannot be recovered.
  2. Usage specifications:

·Remote control function may only be used to control TVs that you lawfully own or are authorized to use, not for controlling public or others' TVs.

·Screen casting function may only transmit resources that you lawfully own or are authorized to use, not for disseminating illegal content.

·Game mode should be used within a reasonable duration; minors must be guided by their guardians to avoid addiction.

VIII. Third-Party Services Explanation

Some functions of this App rely on third-party services or content. Your use of such functions constitutes your understanding and acceptance of the following terms:

1. Scope of third-party services:

·Screen casting protocol support: Some screen casting functions rely on third-party screen casting technologies (e.g., DLNA) or the TV's built-in screen casting service. The screen casting effect is determined by the compatibility of the third-party service.

·TV mini-game content: The mini-games in game mode are provided by the TV device itself or third-party game service providers. This App only provides controller adaptation and does not participate in game development, operation, or content review.

2. Liability disclaimer:

·We do not make any warranties regarding the legality, accuracy, security, or stability of third-party services, nor are we responsible for disputes arising from the use of third-party services.

·Disputes between you and a third party should be resolved directly with that third party; we will not intervene.

IX. Intellectual Property Protection

1. All intellectual property rights of this App (including but not limited to software code, remote control protocols, interface design, theme styles, function names, trademarks, logos, button sound effects) belong to us or the relevant rights holders, and are protected by the Copyright Law, Trademark Law, and other laws and regulations of the People's Republic of China.

2. Without our explicit written authorization, you may not:

·Copy, modify, or disseminate the software code, theme materials, or button sound effects of this App.

·Imitate the interface design, remote control logic, or theme style of this App to develop similar products.

·Use trademarks, logos, or function names identical or similar to this App to confuse the public about the source of services.

3.If you believe that content within this App infringes your intellectual property rights, you may report it via the email address in the "Dispute Resolution and Contact Information" section of this Agreement. You must provide proof of ownership, location of the infringing content, and other materials. We will verify and handle the matter in accordance with the law within 15 working days.

X. Service Risk Disclaimer

This App is provided "AS IS". You acknowledge and accept the following risks. To the extent permitted by law, we are not responsible for:

1. Functional limitations:

·Remote control compatibility is based on publicly available protocols of major TV brands; we do not guarantee support for all models. Some older TVs may experience issues such as button unresponsiveness.

·Screen casting performance is affected by the TV decoder and file format; we do not guarantee that all file formats will play properly. Game mode performance is affected by TV performance; we do not guarantee a lag-free or bug-free experience.

2. Uncontrollable factors:

·Service abnormalities caused by force majeure (natural disasters, public health events), TV device failure, Bluetooth signal interference, or network interruption – we are not liable.

·Due to business adjustments, legal requirements, or technological upgrades, we may suspend, interrupt, or terminate some services. We will notify you via in-app announcement 30 days in advance, and we are not liable for any indirect losses arising therefrom.

3. Data risks:

·Usage duration statistics are only local records and may have slight deviations due to device system errors. They are not legally binding and may not be used for commercial proof or dispute evidence.

·We are not liable for any decision-making errors resulting from your misunderstanding or misuse of data (e.g., misjudging usage duration, relying on screen casting content).

XI. Limitation of Liability

1. If direct loss is caused to you due to our fault, the compensation amount shall not exceed the total amount you paid for paid services of this App in the 12 months prior to the incident. If you have not paid any fee, the compensation cap is RMB 100.

2. We are not liable for any indirect, incidental, special, or consequential losses.

3. Losses caused to yourself or third parties due to your violation of this Agreement shall be borne by you.

4. To the maximum extent permitted by law, we are not liable for service interruption, functional abnormality, or inability to use caused by device incompatibility, system limitations, network fluctuations, or other reasons not attributable to our subjective fault. You expressly agree: Under no circumstances may you demand a refund, fee reduction, or any form of economic compensation from us on the ground that the product cannot adapt to your device.

XII. Special Provisions for Minors

1. This App is not intended for minors under the age of 14; such minors are not permitted to use this App.

2. For minors between 14 and 18 years old, the guardian shall fulfill the following obligations when the minor uses this App:

·Guide the minor in proper operation, avoiding screen casting of others' private content or accidental payment actions.

·Control the duration of game mode use to prevent addiction.

·If you discover that a minor has used the App without your consent, you may contact us to assist in deleting local data on the device. We will handle the request within 15 working days.

XIII. Dispute Resolution and Contact Information

1. Dispute resolution: Any dispute arising from this Agreement shall first be resolved through friendly negotiation. If negotiation fails, either party has the right to file a lawsuit with the people's court at the defendant's domicile.

    Feedback requirements: Please indicate "Agreement inquiry / Function failure / Infringement complaint", and provide device model, device OS version, description of the issue, and relevant screenshots (e.g., of the error page). We will reply within 15 working days.
  2. Miscellaneous: The headings of all terms in this Agreement are for reading convenience only and do not affect the legal validity of the terms themselves. If any term of this Agreement is held invalid or unenforceable, the remaining terms shall remain in effect. Our failure to exercise any right under this Agreement shall not constitute a permanent waiver of that right.
